Julia Surbaugh will remain behind bars pending her new trial on murder charges after a hearing last Friday before Circuit Judge Richard Facemire.
After the West Virginia Supreme Court of Appeals reversed her first degree murder conviction last month and awarded her a new trial, Surbaugh sought to be released from prison on bail while she awaits her new trial date. Surbaugh, age 40, formerly of Webster Springs, testified at last Friday's hearing by closed circuit television from the Lakin Correctional Facility located in West Columbia (Mason County), West Virginia.
Surbaugh, and her new court appointed lawyer Kevin Hughart of Kanawha County, pleaded with Judge Facemire to release her so that she could be with her children for the holidays. Webster County Prosecutor Dwayne Vandevender opposed the request, arguing that in light of her conviction (although over-turned), she remains a flight risk and should not be released. Judge Facemire denied bail and granted her lawyer's request to have a period of three months to prepare for the new trial.
Julia Surbaugh gave up her rights to the children three years ago when she committed a murder of the children's dad. When she talks about wanting to be with HER children for Christmas, that can't be. The children were adopted two years ago.
